NatalCalculator.com respects the intellectual property rights of others and expects users of the Site to do the same. We respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act ("DMCA").

Filing a DMCA notice

If you believe content on the Site infringes your copyright, please send a written notice to our designated agent at [email protected] with the subject line "DMCA Notice." Your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorised to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material on the Site that is claimed to be infringing, with sufficient detail (URL) to allow us to locate it.
  4. Your contact information: name, address, telephone, email.
  5. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.

Counter-notification

If you believe material you posted (e.g. via the contact form) was removed by mistake or misidentification, you may submit a counter-notification to the same address. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the removed material and its location before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone, and consent to the jurisdiction of the federal court for the judicial district in which your address is located, or for any judicial district in which we may be found.

Response timeline

We acknowledge DMCA notices within three business days of receipt. Where the notice is complete and the material is clearly infringing, we act to remove or disable access within five business days. Complex cases — where fair use, licence terms, or the identity of the rights-holder are genuinely unclear — may take longer; we will communicate the delay. Incomplete notices cannot be acted upon and will be returned with a request for the missing information.

Fair use and other defences

DMCA takedown notices should be filed only where there is a genuine good-faith belief of infringement. The general vocabulary of astrology — sign descriptions, planetary keywords, house meanings — is part of a common cultural tradition written about for two thousand years and is not copyrightable as such. Commentary, criticism, and quotation for the purpose of review or analysis are protected as fair use in the United States and fair dealing in the United Kingdom. If you are unsure whether a particular use on our site infringes your rights, a preliminary inquiry before a formal notice is welcome.

Repeat infringers

It is our policy to terminate, in appropriate circumstances, the access of users who are repeat infringers.

Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or that material was removed by mistake may be liable for damages.
